NEW:Bus driver charged with rapeBy Heidi Bell Gease, Journal staff

A school bus driver accused of raping a 10-year-old girl on a Meade County school bus made his first appearance in circuit court Tuesday.


Stanton Day, 65, is charged with first-degree rape and sexual contact with a child in connection with an incident that allegedly happened March 1.

According to documents filed in 4th Circuit Court, Day is accused of performing sex acts on the student in the early hours of March 1 while the bus was parked in the Weston Heights subdivision north of Rapid City. The law enforcement officer who arrested Day on March 5 said Day admitted to his actions.

“It’s every parent’s worst fear realized,” said Meade County State’s Attorney Jesse Sondreal. He said it is “highly likely” that Day will face additional charges.

Day made his first court appearance Tuesday and is being held without bond pending arraignment March 26. The maximum penalty for first-degree rape is life in prison. Sexual contact with a child under 12 years old is punishable by 15 years in prison upon conviction.

It makes me so mad that they wouldnt have two people on the bus....a parent, or another employee...kids should never be alone like that.

Bus driver gets 17 years for molesting girl

STURGIS The Meade County bus driver who pleaded guilty to molesting a 10-year-old girl was sentenced Wednesday to 17 years in the state penitentiary.


Stanton Day, 64, of Summerset pleaded guilty in July to two counts of sexual contact with a child younger than 16 and three counts of sexual exploitation of a minor.


As part of a plea agreement, several other counts were dropped.


Fourth Circuit Judge Warren Johnson sentenced Day to 15 years in prison on each of the sexual contact charges to run concurrently and two years in prison on each sexual exploitation count to run concurrently with each other and consecutive to the 15-year sentence.


Johnson said Day will be eligible for parole about halfway through his sentence.


Meade County States Attorney Jesse Sondreal asked for the maximum possible sentence of 36 years in prison, saying Day has already experienced leniency in having several other counts dropped as part of the plea agreement.


The victims mother and father testified at the sentencing hearing.


He stripped her of her innocence as a child, the victims father said. These are things shell have to deal with the rest of her life.


Day, who has been free on bond since his guilty plea, was remanded to the Meade County Sheriffs Office for transport to the penitentiary in Sioux Falls.

With the Supreme Court reviewing Lethal Injection as capital punishment, I'd like to remind them just how effective firing squads are....like here would be a perfect case.....furious

Hopefully he'll get what's coming to him while he's in prison.  I've heard/read that child molestors aren't liked very much by the general prisoner population, and they tend to met out their own form of punishment. 

But yeah, I agree with some of you......he should be shot!!

i caught the tail end of a radio discussion this morning on prisoners somewhere claming lethal injection unconstitutional --  cruel punishment.  anyhow... they went on to say that oklahoma was the first state to legalize lethal injection as capital punishment, but capital punishment by firing squad is still on the books.

can y'all BELIEVE that he might be on the streets in 7 years?  if he doesn't get shanked first...   doesn't one serve more time for parking ticket violation?!!??furious
