Rubinoos vs Avril Lavigne (and what about Tony Basil?)


Sparky posted a youtube clip showing how close the chorus of the Rubinoos "I wanna be your boyfriend" is to Avril Lavignes "Girlfriend"

I read later that there is actually a lawsuit pending over it.

Someone in the forum also commented on how similar to Tony Basil's "Mickey" the song is.

So we'll play em' back to back to back and see what you think!

The only part of the Rubinoos song that sounds like Avrils is the "Hey hey, you you" part. I think the beats of Mickey and Girlfriend are similar, but not the same.

What about "hey, you get off of my cloud". Girlfriend chorus sounds similar to that song too. Her chorus has similar wording to the Rubinoo's but they are somewhat different.

She mentioned that song by the Stones in her rebuttal on her website.

But still, like I said, Ray Parker Jr. won against Huey Lewis when he claimed I WANT A NEW DRUG sounds too much like GHOSTBUSTERS.

That case was based on the music, not the lyrics, but I never really saw how he could win that case.

IN FACT, I always thought GHOSTBUSTERS sounded too similar to THE HEAT IS ON by Glen Frey in that the openings are so much alike. Often when one or the other comes on the radio I'm not sure which it is.

But you can't base every single music copyright infringement case on that one case, especially if you don't see the reasoning behind it.

In fact, off the top of my head, I don't think those two (or three) songs are similar.  Will you play those too?

Don't get me wrong Hartz, I'm not disagreeing with you.

I think most of this stuff is silly.

I only point out the Huey/Ray Parker case because if HE could win it I can't put ANYTHING past a judge (or jury?) when it comes to this.

I don't know the laws in this area, but they must have a pretty liberal interpretation of what constitutes copyright infringement.

Last night I was watching "The Bronx Is Burning" on ESPN.  It's a story about the '77 Yankess and all that went on in New York that summer.

The Son of Sam killed a couple sitting in a car, they were listening to a Ramones song that kept repeating the words "I wanna be your boyfriend", for a moment I thought it was the Rubinoos.

Maybe I should call the Rubinoos and tell them to add the Ramones to their lawsuit.
