Howdy Folks,

I'll be home with the boy this afternoon. Our high school football team is going to playoffs and they have a game quite some distance away, so school is letting out at out at 1:00 so people can have time to get to the game.

Its nice and bright in my shop today. Yesterday, I got tired of it being so dark so I went to the hardware store and bought a box of fluorescent bulbs. There's 40 bulbs total out there, and I replaced 10 of them that were bad. Six of them were right over my bench where I work the most. What a difference that made . . . my old eyes can see again.

My wife did not sleep last night. She's pretty upset. She was reading the lawyer's contract on her mom's will and found where the lawyer is to get 3% of all assets and estate finances weather they have beneficiaries or not. If that is true, that means the lawyer gets 3% of the life insurance that my wife took 15 minutes to fill out a form and send it. The lawyer won't even be doing a thing with that and she gets 3% of it?

I don't understand how a lawyer with any hint of integrity or sense of self worth can slip things like that through on people and still sleep at night.

Hidyho neighbors! Its my day off again biggrin.gif since I worked Sunday. I have no idea what I am going to do today, but its the last nice day for at least another week. Sparky was going to take the afternoon off but he sucks and thinks he has WORK to do. So its just us gurls...hmmm...I wonder what kind of trouble we can cause today??

Unfortunately, yes . . . because her mom asked the lawyer to be the "personal representative" so my wife wouldn't have to face the wrath of her brother. When she did the will, my wife's brother was acting pretty unstable so they thought it would be best to have the lawyer be the buffer between them. I don't think that her mom understood that meant 3% of EVERYTHING with her name on it, however.

That sucks Web!

To be honest though, never having gone through that, I would have guessed the lawyer would get a much bigger cut. Seems like Lawyers won't pick up a phone unless they get a double digit percentage of something.

Since the station went down I've been extremely busy rearranging stuff in the house, setting up a new office, etc. When I get really into a project I find that I can't sleep, I just want to go, go, go.

For the first eight days I literally was sleeping 2 - 3 hours a day and felt FINE.

But now all the rearranging is done and WOW did that sleep deprivation catch up with me. I slept GREAT the night before last and got 8 hours. I thought that was my catch-up day, but last night I slept TEN hours!

Hopefully now I can settle into a more reasonable 6 hours or so smile.gif

Web, I don't understand how the lawyer gets anything from the life insurance policy; usually all the proceeds of life insurance goes to said beneficiary once the claim is filed.  The check will be issued directly from the insurance company then mailed out to the beneficiary.  Something seems a little odd about this.  Is the life insurance policy specifically listed in the contract that it's subject to the 3% the attorney is to receive?

That's what she's worried about . . . we don't know yet for sure. She is worried that the insurance is included in the estate but she is going to talk to the lawyer to make sure. I hope she is worried about nothing, at least on the insurance part.

Another day almost gone. I am so glad that tomorrow is Friday!!! I cooked dinner, cleaned house and I am about to sit down to a nice cup of coffee. I love this time of year. It is rainy and 58 degrees. Perfect!smile

As far as I know, life insurance is not part of anyone's estate......the only time it would be considered part of someone's estate is if a person died and their beneficiary also died, and there are no other people listed as contingent beneficiaries.....then the proceeds would become part of the deceased's estate and would have to be probated as an assest of the estate.  

I'm hoping your wife gets the full sum she's entitled to!  

A couple of side notes: 
A good insurance salesman will always tell his/her clients to have at least two beneficiaries on a life insurance policy because it keeps the insurance policy out of probate court if the insured and a beneficiary die at the same time.

Also, if any of you have a life insurance policy provided to you through your place of employment as part of your benefits package, you are allowed to have more than one beneficiary on that policy.  There are a lot of employers that fail to tell their employees this.  You are allowed to designate as many primary and/or secondary beneficiaries as you want.  And on secondary beneficiaries you can also specify if the money is to be split equally among them or you can do it in percentages......such as beneficiary 1 is to receive 50%, beneficiary 2 is to receive 25% and beneficiary 3 is to receive 25%.  Some people that have problems with certain family members do it this way.

I don't think anyone can touch the insurance....That should be a seperate part of what's left for the family...should not have to go thru probate at all!

No, but I worked at John Han**** Life Insurance Co. for 8 years and learned an awful lot about insurance.  smile
