Madison Federal Judge: Nat'l Day of Prayer Unconstitutional

MADISON, Wis. (WTAQ) - Federal Judge Barbara Crabb of Madison says the National Day of Prayer is unconstitutional, because it violates the 1st Amendments ban on laws establishing religion. Crabb ruled Thursday in favor of Madisons Freedom from Religion Foundation, which filed suit against the White House to end the presidents annual proclamation.

Foundation co-president Annie Laurie Gaylor called the decision courageous. She said it invades Americans freedom of conscience when the president tells them to pray. The Justice Department says it will review the ruling before deciding whether to appeal it.

Jordan Sekulow, an attorney for a legal group started by evangelist Pat Robertson, is confident Crabbs decision will be overturned. He says it does reflect the mainstream of judicial thinking throughout the country. Crabb says her decision will not be enforced until all appeals are exhausted. So the White House said it would declare the National Day of Prayer for May 6th. The day had its origins in 1952, when the Reverend Billy Graham called for such an event.

Congress passed a law in 1988 setting the first Thursday of May as a National Day of Prayer. Former President George W. Bush held activities on that day. President Obama ended those events, but he still issued the declaration and encouraged Americans to pray on their own.

no.gif Un-freakin-believeable! They actually sued over this? Is anyone actually being FORCED to pray? Not that I'm aware of! So what if the President asks people to pray? One can always say 'no'. Its not like anyone is being fined, jailed, or taxed for non-participation. The people who are inclined toward prayer will pray as they probably would anyway, the people who aren't, won't. No big deal either way.

How cold hearted can she be? It's just a day of respect. It doesn't matter who you're praying to or why. So people will get together for a day to pray, what's that going to hurt?

I can't stop thinking about this. Everyone knows I'm all for freedom of religion and freedom from religion, but this is taking it too far.

"freedom of conscience" WTF? Sometimes the line is gray on right and wrong for some issues, but the important part is that we're thinking about it. We're using our conscience. But what is "freedom of conscience"? That we're not supposed to encourage people to determine right from wrong?

Yeah, that "freedom of conscience" really threw me off too. Its like they are saying that if the president proclaims something, it removes all conscious thought about it. Does the president really have that much power over us?

I also don't understand how this judge can stretch a president's proclamation for something into it being the same as a law establishing it.

Well, they can take away the day of recognition, but those who pary will do so no matter what...

Seriously, do they really think that cancelling "the day" will actually halt prayer? Do they really think that if it came down to the extreme and we would be exiled or put to death, or worse taxed, for praying, we'd actually stop?

Some people just need to get a life...

This is actually great PR to get people to pray more!

I don't think they want people to stop praying, they just don't want the president to advocate it. I still don't understand why though.

It is just dumb that people are so hyper-sensitive to things like this. What next? Are we going to sue to stop Labor Day because it might make unemployed people feel bad? Are we going to sue to stop Memorial Day because we have war protesters?

That Constitutional Amendment was hijacked.  It was INTENDED to protect religion from Government not the other way around.  Government has ALOT of resources to protect itself.  Hypersensitivity is going to probably lead to some consequences people arent foreseeing or prepared to deal with.

no.gif It is a choice. It is not hurting anyone. The country was founded so we could have Freedoms.

So, if governments are so hung up on the whole "separation of church and state idea" someone please explain to me why is it then that government offices are closed on Good Friday and Christmas?

Fuzzy, actually the whole separation of church and state came about so taxation wasn't supporting a particular religion or church.

Ok, going with what you're asking......

The Constitution gives you the freedom and the right to choose whatever religion you wish to follow and attend whatever church you wish to attend.

It also means that none of our tax dollars can be earmarked for any religion or church.

Since government workers can follow whatever religion they choose to follow, our tax dollars aren't supporting their religion. 

Remember King George of England?  He was Protestant.....England didn't want him as King because he wasn't Catholic.....most of the wealth and land was held by Catholics, therefore, they tried to dethrone George and replace him with a Catholic. There's a lot of history that you'd have to go back through and read to really understand why they wanted this.  

Back when they were framing the Constitution, they were very concerned with taxes and what the tax dollars could and could not be used for. They didn't want the government set up in any way that was based on one particular religion.
