Does Judge Alito appear to be a good pick for the Supreme Court bench?

Should A Supreme Court Justice be held to strict Constitutionalist standards, or do you think that a judge has a right to legislate from the bench?

Alright, I was getting ready to go, but I am always game for this!!!


 


Well, first off I am surprised that he did not choose another woman. I also wonder what they were hiding for Miers to have pulled out. With that said...


 


Alito is too a scapegoat. I am amazed at how smoothly the first nomination process went. Especially considering Bush went high for that one instead of filling O'Connor's seat first. But the infighting of our politicians is pathetic and the main reason why going to law school or pursuing political science at a higher level for me is now a turn off. Our whole government is messed up. Every branch, every department, and almost every member. But there is no solution to fix it that will ever work. The world just got too big for the form of government that we choose to work well.


 


Ok off soap box, back to question...


 


Yes I feel it is ok to be a judge and legislate from the bench. The reason being is somewhat explained above. Even the Bible's message can get altered as time passes and we are faced with new problems that were never thought of by its author(s). I do not think they have a choice in some areas. I also believe that a judge would never do that if they did not have a solid ground to stand on.


 


I do not truly know enough about the court to see his fit. However, I know that the founders never intended judges to be picked to balance political views, they were to be neutral and lead us when we cannot lead ourselves!

        NO ! judges should not legislate from the bench , thats not what there paid to do !


 They are there to interpert constitutional law , not make law, that is what the congress is for.

well...law is an ever changing animal to meet unexpected and new social behaviors...

Youre right...the founding fathers never could have imagined air travel, the internet or
even the number of people or land mass we have.

But I dont think the concept of democracy is outdated...I just think that as a people we are less concerned with government and our elected officials than with Desperate Housewives. It only works when we all are involved.

I think every judge brings a certain bias to the bench...its called being human, however...complex issues, decided through the prism of the Constitution have only one goal...that every decision fits the framework of our house...a democracy with checks and balances and a chance to be heard.

The system isnt perfect...but no one seems to have taken the dignity of the individual more in to account.

Judges should not make law, only see that it is enforced and interpreted.  Dylan is right, and I pray all the time for our democracy.  I thank God for our three branches of government.


I have said before and say again, that the surest way for evil to triumph is for decent honest men to do nothing.  Of course I include women in that too.  I am frightened at the apathy that prevails through this country--and incensed when I speak my mind here in my community and am attacked for making waves.

May I encourage everyone to use thier voices next Tuesday.  Please vote.  A person, in my opinion, has no right to complain if they have never even voted.  I don't care how you vote or what political party you are voting--just vote.
