Is It Littering? Philosophy 101


So this turkey and his girlfriend are in the car ahead of me today. They are both throwing what looks like peanut or pistachio shells out of the car window, 1 by one, as they munch away. This dumba$$ kid even rides the brake when he throws his shells out the window...annoying twits.


But. Is littering nut shells actually littering? They are not litter when they are on the tree. It doesn't seem to have quite the same offense as if they were littering the street with say McDonaldland wrappers or 1/2 eaten food.


I was thinking, well it probably would be littering if they were tossing out orange peels from the car. These eventually rot, even tho they are not litter when on an orange on a tree.


Then I thought the qualifier was the amount of shells. If they were to dump a truck load of nut shells into the street, that would be dumping/littering. But then again, when birds leave seeds & shells beneath a bird feeder, that's not littering.

If something will eat it- like a bird or dog, then I think it is ok. But not in large amounts. The peanut shells came from the earth, so I say throw em! I read not too long ago about a lady who was arrested for littering- she threw the lettuce off her burger out the window of her car. I thought it was stupid.

This is a load of crap!


 


She tossed the lettuce, and a cop tossed her a ticket. Yesterday, a woman who says lettuce is not litter tried to make her case to a judge, and she didn't come to court empty-handed. WFMZ's Mike Lowe has more.

Dawn Higgins doesn't like leafy spinach on her salad.
(23:43) "It looks like something that came off a tree."
So last October when she and her daughters stopped for a quick bite at McDonald's , and then pulled into a nearby parking lot so she could eat , she picked off the leaves -- and tossed them out the car window.
That's when police officer Thomas Mahalick spotted her.
"She was throwing items out of her vehicle. They were lettuce." (20:31) "I said: it's not littering. It's lettuce."
(14:34) "He eventually ended up citing her for what was 6 leaves from her McDonald's salad -- no dressing."
The dispute over whether lettuce is litter wound up in county court. Higgins' attorney says the case is ridiculous.
(15:13) "Not to use legalese, but it's a "de minimis infraction." The statute says the scattering of rubbish or refuse on private property or roads or on any type of surface, but it doesn't define what rubbish is."
He says Pennsylvania case law provides only one precedent -- a case in which a cigarette was deemed not to constitute "rubbish." "So our argument was simply that 6 leaves from a salad which is biodegradable -- and may have blown onto the grass -- were even more minimal than a lighted cigarette."
Her attorney says she may have been cited more for her attitude than her actions.
(19:55) "I did have a little bit of an attitude, but who wouldn't? I think anyone in their right mind would have been pissed off just like I was."
(14:34) "He cited her $50 dollars, plus court costs, plus a $173 fine for those leaves. Probably the most expensive McDonald's salad ever sold."
(18:32) I feel terrible. I think I got robbed."
(12:02) "If it would've been any other outcome, it would've shown the public it's OK to litter."
But the judge agreed with the cops , and Higgin's was ordered to pay a steep fine.
She says she'll appeal to superior court.

That was Mike Lowe reporting.
After hearing Higgins' story in court, a judge ordered her to pay a fine.
She says all-together she's had to pay more than four hundred dollars in fines.

well, I'll be! I had no idea that this was actually an issue being disputed in court like this. I am glad. It ticks me off when people throw stuff on the ground. Its low class. Its ghetto.
