May 15th Could Be The Last Day of Internet Radio..


unless Congress intervenes -- royalty rates webcasters must pay will increase on May 15 between 300 and 1,200 percent, retroactive to January 2006. As a result, "the very large majority of Internet radio stations will go bankrupt," Jonathan Potter, executive director of the Digital Media Association (DiMA), told TechNewsWorld.

"The CRB's denial of a rehearing today is all but a nail in the coffin for Internet radio, and May 15 now looms as the day the music will die," Potter stated. "Internet radio provides exposure and royalties for thousands of independent artists and labels that are not represented by broadcast radio -- and last year, 72 million people tuned in every month. We call on Congress to step in to save Internet radio for the artists, the labels, the webcasters and -- most importantly -- the tens of millions of listeners..

I just stepped in to turn on the two-fer Tuesdays and saw this thread, thought I'd let you know where we stand right now.

May 15'th is indeed the big day.

In an ironic twist, we may temporarily see a big increase in listernership after that date.

Live365 is set up as two types of broadcasters:

PERSONAL

This is what we are.  A "personal" broadcaster is allowed anywhere from 10 - 100 free listeners and unlimited VIPS at any given time, depending on how big of a contract we signed.

PROFESSIONAL

Pro broadcasters pay live365 for their streaming services, but have no limits on how many can tune in.  They do NOT pay Live365 for royalties, but instead are required to pay royalties directly to SoundExchange every year.

These are the ones immediately impacted on May 15'th.  As of that day, if no new agreement is reached, they MUST pay their debt to SoundExchange, not only for this year, but the difference between the old rate and the new rate for ALL of 2006.

Most Pro stations will shut down completely on this date. 

These stations have as many as 400,000 listener hours a month.  Those listeners will seek out a new station to listen to, and we may well see a big increase as a result.

As a PERSONAL broadcaster we are protected by our contract, but Live365 is liable in a HUGE way. 

Our future is completely in their hands, as they decide what to do about owing a tremendous amount of money for the past 17 months.

Some possibilities are...

1)  Cancel all contracts and shut down completely.

2)  Disallow live broadcasts (which allows them to insert commercials, but destroys our ability to DJ and the listeners ability to request music)

3)  Eliminate all "free listener slots" and make their network a subscription service.

Of course, there are other options too, but these are the three that seem to be getting the most play on the broadcaster-only forum at Live365.

Long story short, May 15'th does not pose an immediate danger to us unless we hear differently from Live365.  Our contract runs through early August, at which point we would not renew unless everything remained pretty close to what we're used to.  We can't afford a major price hike.

Of course, every day that goes by Live365's bill to SoundExchange gets bigger and bigger, so there is a very good possibility we WILL hear from Live365 before the 15'th, letting us know what changes are going to occur.

what bothers me about this whole thing is that I feel we do this to help keep great music alive, "out there". Heck, RIAA should pay US to be doing them this favor!

They honestly don't seem to see it that way JD. 

I know you don't get into TV on DVD, but recent stories about shows having trouble coming out on DVD have really illustrated how insane the RIAA really is.

WKRP used tons of music, and had to be released with almost all the music replaced with generic stuff.  In that show the music was essential to the joke a lot of the time.

The reason they had to go without the music is that the RIAA wants up to $50,000 per song used and that would have added millions to the cost of producing the set.

But here's the thing that shows how insane the RIAA is.  Most of the music in WKRP was just a 10 - 20 second snippet.  Like Johnny Fever saying something, starting a song and walking out of the studio.  But the RIAA treats that as a performance and requires full payment.

How INSANE is that?

Is someone going to copy the 10 second snippet and cost the artist a sale?  OF COURSE NOT! 

The ONLY thing that could come from that 10 second snippet is a bunch of viewers saying to themselves "oh man, i forgot, I love that song, I gotta buy that".

This to me really illustrates how short-sighted the RIAA is and how they really don't give a crap about artists at all.  They just figure FOX is deep pockets, so they'll cough up the huge licensing rights AND give the songs free advertising.

I've listen to live365 for years. Remember when you could broadcast and listen for free. my brother had two or three stations going, when he had to pay he went to just one. Now he doesn't broadcast at all. Money, money, what makes to the world go round. This will be a shame and a loss to everyone.

You know, if the artist would get some of the cash... I wouldn't mind it as much. If part of the money would go towards the promotion of new sounds and listening opportunities.
I'm not a big fan of paying for limos to business meetings in L.A. or N.Y.
Company jets, vacation spots, etc.
I'm not against member fees.
Gosh, I feel stupid. I've been online listening to stations from all over the world, for free! I have been know to buy something for myself, as a donation to my favorite stations.
