I May Be Moving


For those that didn't catch what I said in the Right Now Thread- here is a recap:

My landlord called me at work yesterday to ask if we wanted renew our lease. Also keep in mind that he actually had to get off his butt and pay to get rid of the bees in the wall. He is an absent landlord and never fixes anything he says he is going to. But we rarely call him about stuff. And he has never raised the rent.
I told him that our intention was to renew when we called him back in April. Our lease ended in May. He asked when we wanted to start the new lease. I told him that I thought we were in a lease. (verbal) He said that we were doing month to month. I started to get mad and didn't know what to say. He then said to discuss it with my husband and get back with him. I looked up a MI renters guide which states that unless it is stated in the previous lease about going month to month then the previous fixed term lease is implied if you continue to occupy the residence an the landlord cashes the checks.

So I went home and checked the lease and there is a statement in there about going month to month. However it pisses me off because he acknowledges that April phone call- so wouldn't that be a verbal agreement? He said that it was okay for us to stay another year and that he would get the lease right out to us. He didn't but that isn't our fault that he didn't do his paperwork! So we are figuring that he wants a new lease starting now so he can jack up the rent. He can't legally do that if he goes back to May because he has been accepting the current price these past months.

Due to my husband having a really bad headache last night we did not call the landlord back. But my husband does not want to stay longer in a new lease and definitely doesn't want to pay more for an absent landlord! He said if the rent got raised that he would throw all the repairs back in his face: fixing the garage floor, holes in living room floor(under carpet), painting the house, re roofing- all that was supposed to be done the first year! Things he said he was gonna do. The only thing that was our complaint was the living room floor. We also told him that the garage roof is leaking several months ago- but still not fixed. furious

So we have no money saved but in the end we may have to move. cry

I'll bet if you tell him you'll sign the May lease at the current rate or you'll be moving, he'll give in to the May lease. Most landlords want to keep their current renters as opposed to finding new ones. Plus, I don't know about there, but here it's the worst time of year to try to rent something out.

I hope it will work out. the only reason we closed off our room (finally) and painted the bathroom is because we thought we would be there. It'll suck if we gotta go.

Well I will pray that you can stay and keep the same rent. I think MZ is right- if you pay your rent and don't complain much, he would be stupid to let you go!

Woo...if he does raise the rent or wants a new lease from today.....turn him in for the substandard housing conditions that he didnt fix. biggrin.gif

Sorry Woo.  I agree with everyone else, he'd be a fool to lose several months rent trying to get extra out of tenants he already know's he can trust in there.

I managed a 16 unit apartment complex for two years and I could not believe what 90% of those apartments looked like after someone moved out.  fist-sized holes in the walls, doors off the hinges, etc.  I even had one guy that brought a huge motor into his living room and was working on it right there on his carpet!  The whole place had oil all over it!

The point is if you have people you can trust, that pay the rent on time, DON'T SCREW WITH EM'!!!

Hopefully he'll think again if you threaten to walk!

So my husband called the landlord last night and as long as he doesn't raise the rent we will be staying.

My husband put the phone an speaker phone so I could hear. He at first said that we went month to month after our original lease expired. My husband said that we did not want to move in later months due to the weather. It seemed like his wife said something in the background and all of a sudden "Well I can retro it back to May if you want." So they agreed on that. My husband doesn't think he would raise the price then, but I don't know. We will see. I was mad that he gave ME such crap and had all but a 2-3 min conversation w/ my husband and was easy as can be. My husband barely said anything at all. He was all prepared to bring up things but didn't have to. Hopefully this is all resolved. But come next May I bet we can expect a raise in rent. I would just rather move if possible. We weren't in a good place money wise to move but there would have been possibilities of closets, dishwasher and bigger or more bathrooms. It wouldn't have been all bad.

Woo, I'd guess he's probably one of those guys that can intimidate a woman but acts normal to a guy. Your husband should probably call him from now on. Either that, or your conversation got him to thinking about what a pain getting new renters would be.

The only woman he seems to listen to is his wife , if she did in fact say something to him while my husband was on the phone with him.

I never call him, he just keeps calling me at my work desk. hmm
