ok..so the rent is due on the 16th for our old house. Its the 17th and its not in my account yet...I have in the rental agreement that there is a $50 late fee....do they owe it today? even though the 16th fell on a Sunday? That is if I get the money today hmm.gif

Technically yeah. they are able to see where the 16th will fall and it is up to them to make sure the money gets there on time.

But then again I guess it depends on how nice you want to be.

I already changed their due day from the 12th to the 16th to make it easier for them...I feel sorry for them but on the other hand...I need the money. The mortgage payment is due and if I dont have their rent it comes out of my pocket...and mine arent very deep right now. hmm.gif

Getting technical, yeah, they owe it. I have until the 3rd to pay without a late fee. If I put a check in the slot, as long as it's there by time they get in the morning of the 4th, I don't get a late fee. But if I do it online or mail it, they have to have it by midnight on the 3rd.

But it sounds like this might be some sort of direct transfer thing? How do you know when they did it? I'd say as long as they initiated the transaction on or before the 16th, you should waive the late fee.

they just go to the bank and pay it....and all my bank transactions through yesterday are showing online and its not there. I am glad I looked because I had my payment set up to automatically pay today and I didnt have enough to cover it. His payday is the 15th and they pay me the 16th...I KNOW he got paid on Friday...so he had friday night and saturday am to get it to the bank.

Unless they have built into the agreement that if the due date falls on a Sunday or legal holiday (you know, bank closed), I would say he owes the $50. And since you have already made concessions by moving the due date once, I wouldn't accept anything less. It also would be another thing if they were to call and say, "Hey, we have the payment but can't get to the bank until Monday."

so dude calls me and tells me he just got his paycheck and is going to the bank right now...so I think ok..be nice....then he tells me he is $50.00 short...so I do I make him give me $100 on Friday when his wife gets paid? or just what he owes?

Is that short on the rent or short the late fee?

If he is short on the rent, he owes you $100 because the rent is not considered paid until Friday. Therefore, it is late.
