Let's Play the Tax Game


Because I am being super lazy (it is really more in the interest of time), I have a sales tax question for some of you. I am looking to update some out-of-date file that someone decided they need to train new people. If you would be so kind as to weigh in on any state you have knowledge of, I would appreciate it.

Some of you live may in one of these states so it will be an easy answer. If you know about any surrounding states (where applicable), that would be great too. I am looking to know if clothing is taxable in the following states:

AR
CT
IA
IN
IL
LA
MA
MI
MN
NE
NM
OH
OR
WI
WV

I'm pretty sure it is in IL too. I've been to Gurnee Mills several times and believe I've always paid sales tax on clothing there.

Clothing is taxable in Indiana (sales tax is at 7%). It's also taxable in Chicago, but I know sales tax is also higher in Chicago, so I'm not sure if that's state-wide.

I didn't even know there were some states that didn't have to pay tax on clothing...

NM is --- bought Isaac some clothes this summer...

Thanks guys. I am not worried about the rates right now. Most of those are built into my existing spreadsheets for my sales tax calculations. I am looking at updating my use tax exposure.

DS - There is no tax on clothing in PA or NJ. There is no sales tax on anything in DE. NY has clothing limitations. As long as a single item of clothing does not exceed $110 it is exempt. Anything over that is taxed.

Each state taxes differently. And they make it up in other ways.

As an example, we operate in 46 states (I think it is still 46), but our services are not taxable in every state. That would be way too many sales tax returns for me to remit every month. I only file 13 monthly sales tax returns. Add on the seven use tax returns I file, plus 2 gross receipts returns and it makes for a busy couple of weeks. There are a ton of other returns that I prepare for the quater end too.

It isn't too bad. It is more of a routine. As long as I have the information I need, it's okay. When I am working on the use tax returns sometimes I have to wait on AP to provide me copies of some vendor invoices to review. The gross receipts returns don't take too much time. There are an extra 16 returns on a quarter end though. Throw a few more of both kinds in for a year end too.

Clothing is taxable here in MI at 6% in case you need it. smile

Clothes are not taxed here in Connecticut

Here in Nebraska, we're taxed on everything but food and air . . . and I think they are working on getting air taxed.

LS - it seems you guys have a funky rule like NY. As long as an item costs under $50 there is no tax.

Yeah, clothes are considered "Necessitites", which is fine by us here!
