The Big Milwaukee File-Sharing Crackdown


They just announced on the news that Milwaukee County Sherrifs will be appearing on a bunch of peoples doorsteps tomorrow to serve papers that the person is being sued by the RIAA for illegal file downloading!

Ruh Row!

Luckily, we very rarely use those illegal file sharing sites, usually only for songs that can't be purchased on CD or Digital Downloading. None the less, the bird will be keeping one eye on the front door tomorrow!

Well, 12:30 PM local time and so far haven't seen the coppers, I think we're safe!

Like I said, it's VERY rare we get our songs that way. Normally I'll buy off itunes or buy the CD. Recently I've purchased some discs from the Russians, but Kazaa or Limewire are only used for those songs that you just can't get anywhere else because no one cares about them.

I don't think those are the types of songs they track. I think they focus on the current stuff that's making them their money.

Ruby, the record companies have been monitoring the file sharing sites and contact the users internet provider to find out who is doing the file sharing.

I actually had a friend get sued about two years ago by the RIAA.

She wound up settling out of court for a couple thousand I beleive.

I don't know how many she had downloaded.

There are a couple lawsuits going now to fight the RIAA on this stuff. The basic arguement is that once I buy a song I can share it with whoever I want because I own it, as long as I'm not SELLING it.

But the more compelling arguement is on about the issue of privacy. I don't know all the details, but it seems the labels are basically entering yoru computer to determine what you have, and a lot of people feel that without a proper search warrant that's not legal.

How do they know where you got the files from? At one point, I had all my CDs loaded into my computer. Or do they look at download history or something like that?

There's a couple different ways.

They can "packet sniff" and watch the traffic going through connections, and they can set up "honey pots" so that you are pulling songs from them and thus getting your IP logged.

I'm sure there are other ways too.

Molly, you wouldn't have to worry, they start by monitoring the illegal peer-to-peer sites. From there if you're IP is showing up they'll follow the data to your computer (from what I understand. Web may know more about this).

They tend to watch hot new songs files very closely, I don't think they bother with really old stuff because it's not shared as much.

I don't think they can do anything about someone sending us an email with an MP3 or an IM with an MP3.

It had to originate from a Kazza type site.

Yeah, they get the IP that downloaded (or uploaded) the song. That still doesn't tell them who you are as most people are on dynamic IPs that will change every time you dial up or reboot your broadband router. Then they have to get court papers to make the ISP tell them who was using that IP at the time it was logged.

For that reason, some who are going to download illegal music, might take a laptop, drive around for a bit until they find someone else with their wireless access open and download through this unsupsecting victim's IP.

HERE is a story of a lady in WI that is getting sued for downloading music. She doesn't know how to download and her kids are 3 and 7 years old.

These fools (RIAA) need to be stopped.

Geez, if their technique of catching people is that hit and miss they shouldn't be allowed to waste peoples time.

You know Web, I set up a new wireless network in my house this past weekend and was shocked to find THREE other networks (two unprotected) within range of my house. Two of them with very strong signals.

That made it crystal clear how easy it would be for someone to pull up in front of my house with a wireless laptop, download all the music they wanted and drive off, leaving ME look like the guilty party. (or course I'm using the encryption, but like you said, if someone wants to get around it they will).

I think the RIAA should face the realities of the new environment they find themselves in and focus on how they're going to make money in a new and more creative way.
