I was just in a car accident.....


Some bonehead rear ended me while I was stopped at a red light!


My back bumper came off some of its mounts, but is still on tight. it is scratched. I am not injured. The other guy had considerably more damage than I did, but did not need a tow.


We exchanged information, called the police who no longer come to the scene of an accident if there are no injuries. I would have to go to the police station and file an accident report.


Now is where I could sure use advice.....


I am willing, if this guy is able, to go to my dealer, so as not to void my warranty, to get my bumper fixed and replaced, and the guy foots the bill. No police or insurance involved. A lot of money up-front for the guy, but he might save a ton on his insurance being raised in the long-run.


Otherwise, I go fill out an accident report, and then go put in a claim with my insurance company. Even tho he rear-ended me, would this raise my premium?? I am not looking forward to laying down the deductable either!


Anyone been in this situation, any advice?

It shouldn't raise it since he hit you, but it might show up as an incident. I would get an estimate from a body shop asap even before you talk to him again. Chances are there is more damage than you can see. I'm guessing with the damage to both cars its going to be over his deductable anyway.


 


Glad you are ok.


I wouldn't turn it in to your insurance unless you have to.

thats what I am thinkin ally. I did call and left a message at his work number to call me tomorrow- I said if he is able, I get the estimate, he pays the estimate, and he can walk. no police report, no insurance companies, cash or credit and go.

aw hi there pip-


I mean he can meet me out at the dealers and pay the bill directly any way he can, so long as it clears with the dealer. His call, I give him till lunch tomorrow to get ahold of me before I file the report and make the claim.

you may want to think twice about going to the dealer, if they know of damage and then say in a few months you have a strut break then they may not warrenty it later.

yes the car is only a year and 1/2 old. 9700 miles. Still a baby. almost.


we'll see how it pans out, if guy wants to do this route. I am not running around town to get him 3 estimates tho.

Sparky talked to his siter in law and the only reason you would need to contact your insurance is if there is any injuries. Thats just for medical payments if needed.

if you don't want to run around for 3, tell the place you go you want a high one. Have the guy pay you not the insurance company and then you can fix it when you have time and if te bill is less. You have cash in your pocket.

First of all and most important I am glad you are ok. Also glad your car is drivable. I am not sure about there, but here now- no matter whose fault- your rates will go up. Which to me is BS- how do you avoid being rearended? But anyway, here also the police determine who is at fault and always come, we have 48 hours to contact our insurance company and the state to show proof of insurance. So we have no way of not calling in both! Your deductible will have to be paid by him. Call his insurance company if he does not call you and meet your demands by lunch. I would definitely use the dealership to get the car fixed as to not void the warranty. Or at least call and make sure you do everything they tell you to do if you take it somewhere else. That is NOT worth messing with. Finally- yes I am almost done. Don't try to make any $ off this- things like that always come back in another way- karma.


 


I will pray that all goes smoothly- things like this are always so stressful. Was his car nice? Did he look upstanding?

thanks ruby- that's what I was thinking too- if we go the insurance route, he pays the deductable amount too- shouldn't cost me a dime with the exception of rates goin up if we do it this way.


I saw he was going to hit me when he was heading that fast and didnt even see he was until it was too late. I let of the brake when I saw he was coming so as to not resist the impact.


yea his is a BMW Stationwagon. So maybe the cash is an option. He looked like a regular schmoe like me- tired from work, needs a shave, but honest.

Awww man that sucks. And it REALLY sucks that you should even have to CONSIDER not filing a report out of fear of a rate hike!

If you DO go through insurance though you may well get a payoff to sign a form saying you weren't hurt. Those rear-end collisions they get nervous about whiplash. I was paid $500 way back in the 80's by the insurance company of the woman that rear-ended me.

It always sucks when you have a nice newer car though.

My cars are like bumper toys to me, I couldn't care less if they get dented, rusted, smashed, as long as they drive.

There IS a certain freedom in that though. I don't think I'll ever buy a new car again.

That might be true JD, but do not deny your right to grieve! It might not be that important, but it is important to you. You work hard and having a new car never seems to last long enough.

I like the reilability of a new auto....but you are right tho.....always some schmoe gonna come along and dent it, I park outside, there is always bird crap on it.....

I think that's what did it for me though JD. My last new car was anything but reliable. I had the purple bird in the shop more than I had it available to drive the first six months LITERALLY! And it was always breaking down at least once a year.

Now granted, I got a crappy car probably. Just the lemon of the line, but nowadays they make cars and engines so well, they're pretty reliable until they approach 200,000 miles.

I am happy I have two though, just incase something major happens to one.

The best part of having used cars is I carry no collision insurance. If someone hits me seriously enough they'll pay for the damage. If I hit someone the loss is mine on the value of my car. But the savings I've had over the last ten years with no collision premiums and cheaper liability rates has probably paid for at least on car if not both.

I like the idea of "ok I pay for this car for 4-5 yrs" I want at least that long after the payments are done without a car payment. I'll run the sucker into the ground. A new one every decade or so.

My new van sounds like your last one JR. I bought a 70000 mile warranty which expires in about 8000 miles. I was told that I was wasting my money, but now everytime I use it the dealership people are like- gosh you sure have gotten your money's worth! Plus I get free rental cars when they have my vehicle and that in itself has paid for it!

That's true, you did that with your last one.

And the good thing is you know it's been taken care of it's entire lifespan with oil changes and such.

I suppose if you stick with a car that long you probably do alright for yourself in the end, you just bite a bigger bullet those first five years.
